Abstract
Recently, to strengthen its core competitiveness and elevate intellectual property (IP) awareness across the organization, Jiudian Hongyang hosted a specialized training session titled "Patent Mining and Infringement Determination." The event, led by Ms. Tang, Deputy department head of the IP Office at Jiudian Pharmaceutical Research Institute, brought together key R&D and technical teams—including members from the Excipients & APIs Research Institute, Synthetic Biology Research Lab, and Technology Department—to systematically advance the company’s IP management capabilities.
In his opening remarks, Mr. Tan, Director of the Excipients & APIs Research Institute, underscored the strategic value of patent work for corporate growth. He emphasized that in today’s competitive market, efficient patent mining and rigorous infringement prevention are critical to safeguarding technological achievements and securing market advantages.
Ms. Tang focused her presentation on pharmaceutical chemistry, first elaborating on patent mining methodologies. She introduced a "problem-driven approach"—exemplified by industry classics like Omeprazole and Gefitinib—to demonstrate how to extract innovations from technical documentation, product iterations, and process optimizations. By deconstructing the underlying logic of innovation, Tang equipped attendees with a structured framework to identify patentable ideas seamlessly aligned with R&D processes.
Additionally, she highlighted proactive patent portfolio strategies, advising teams to build "core patents + improvement patents" matrices around key technologies. This approach not only fortifies technical barriers but also sustains competitive edges.
For infringement determination, Tang analyzed the "all-elements rule" and "doctrine of equivalents" through a real-world case involving calcium zinc gluconate products. Through interactive simulations, participants gained practical skills to assess infringement risks and preemptively conduct patent searches during R&D. The session also covered design-around strategies to avoid potential violations.
The training blended theory, hands-on exercises, and case studies to foster interdisciplinary collaboration. Attendees praised the program for "breaking down patent knowledge barriers" and providing actionable solutions for patent applications and risk avoidance—directly applicable to their daily work.
